Terms of Service

Effective October 24, 2026.

1. Agreement to these Terms

These Terms of Service (the “Terms”) form a binding agreement between you and Five Peak Ventures LLC, an Arizona limited liability company (“Company,” “we,” “us,” or “our”), governing your access to and use of the FaxOnce mobile application, the website at faxonce.app, and related services (collectively, the “Service”). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, you may not use the Service.

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

2. The Service

The Service enables you to prepare a document and transmit it by facsimile to a fax number in the United States. The application is provided free of charge; a fee is charged for each fax you send. No account is required. The Service is available only for transmissions to United States fax numbers.

You must be at least 18 years of age, or the age of majority in your jurisdiction, and capable of forming a binding contract to use the Service.

3. Fees and Payment

The price of each fax is displayed in the application before you confirm payment. The current price is US$1.99 + applicable taxes for the first document page, and additional document pages are US$0.15 each + applicable taxes; an optional cover page is included at no charge. We may change prices prospectively; the price displayed at the time of your purchase governs that purchase.

Payments are processed by our payment processor, Stripe, Inc. Your card is charged once for each fax you submit. Your bank may require additional authentication (such as 3-D Secure) before a payment is approved. We do not receive or store your full card number.

Applicable taxes are calculated from your billing ZIP code and the fax's destination, and are shown with your total before you confirm payment. Any taxes not collected by us at checkout are your responsibility.

4. Transmission, Resends, and Refunds

Fax transmission depends on third-party telecommunications carriers and on the receiving fax line. We do not guarantee that any fax will be delivered, delivered within a particular time, or received in a particular quality.

If a transmission does not complete because the receiving line is busy or does not answer, you may resend that fax once at no additional charge from the History screen in the application. Other resends or credits may be granted at our discretion through customer support.

Fees are not refundable through the application. If you believe a fax was not delivered or was charged in error, contact [email protected] with the fax reference shown in the application or on your receipt. We will review each request in good faith and may, at our sole discretion, issue a resend or a refund to the original payment method. A fax that the carrier reports as delivered is generally not eligible for a refund.

You are solely responsible for the accuracy of the destination fax number and the content of each transmission. Charges for faxes sent to an incorrect number entered by you are not refundable.

5. Acceptable Use

You agree not to use the Service, directly or indirectly, to:

We may refuse, suspend, or block any transmission, payment, destination number, or user at any time if we reasonably believe it violates these Terms or the law, or presents a risk of fraud or harm.

6. No HIPAA or Regulated-Data Services

The Service is not designed or offered for compliance with the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) or any similar law governing health, financial, or other regulated information. We do not enter into business associate agreements. You agree not to use the Service to transmit protected health information or other regulated data in any circumstance where such compliance is required.

7. Your Content

You retain all rights in the documents you transmit. You grant us a limited license to process, store temporarily, and transmit your documents solely as necessary to provide the Service, as described in the Privacy Policy. You represent that you have all rights necessary to grant this license.

8. Intellectual Property

The Service, including its software, design, and trademarks, is owned by the Company or its licensors and is protected by law. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the application on a device you own or control for your personal or internal business purposes. Use of the application obtained from an app store is also subject to that store’s applicable terms.

9. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY TRANSMISSION WILL BE DELIVERED OR LEGIBLE.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE COMPANY OR ITS MEMBERS, MANAGERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE FAX GIVING RISE TO THE CLAIM OR (B) FIFTY U.S. DOLLARS (US$50).

Some jurisdictions do not allow certain limitations of liability; in those jurisdictions, our liability is limited to the fullest extent permitted by law.

11. Indemnification

You agree to indemnify and hold harmless the Company and its members, managers, employees, and agents from any claims, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of your content, your use of the Service, or your violation of these Terms or of any law or third-party right.

12. Suspension and Termination

We may modify, suspend, or discontinue the Service, or your access to it, at any time. Sections 5 through 15 survive any termination of these Terms.

13. Governing Law and Disputes

These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of Arizona, without regard to its conflict-of-law rules.

Either party may bring an individual claim in small claims court in Maricopa County, Arizona, if the claim qualifies. Otherwise, any dispute shall be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and each party consents to the personal jurisdiction of those courts.

All disputes must be brought in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

14. General

These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Company concerning the Service. If any provision is held unenforceable, the remaining provisions remain in full force and effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, or sale of assets.

15. Changes to these Terms

We may revise these Terms from time to time. Revised Terms will be posted on this page with a new effective date. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
